How Martin Shepherd Solicitors Help You Plan For The Future

Our ability to manage our own affairs may decline as we age. At Martin Shepherd Solicitors, we understand the importance of preparing for such circumstances.

If you or someone close to you is facing challenges in managing finances due to illness, disability, or other factors, seeking legal advice is essential. Our powers of attorney solicitors can guide you through the process, helping you put your affairs in order and ensure your wishes for the future are clearly communicated.

As your solicitors, we will work closely with you to ensure that we have all the necessary information to assist you effectively. Here is what we will need to know:

  • Have you made a Will already? Knowing whether you have a Will in place helps us understand your existing estate planning arrangements.
  • Who would you like to appoint to handle your affairs if the need arises? This is crucial for establishing powers of attorney or similar arrangements.
  • We need to have a clear picture of your assets and income to tailor our advice to your specific financial situation.
  • Do you have any special wishes regarding the handling of your property or assets
  • If you have a particular medical condition, we may need permission to speak to your doctor. This ensures that we have a comprehensive understanding of your health needs when advising on future arrangements.

If you are seeking advice on behalf of an older person, we will need to confirm with them directly that they want to instruct us and gather the necessary information with their consent.

Once we have gathered all the relevant details, we will carefully consider your circumstances and explain the options available to you, ensuring you have a clear understanding of your choices moving forward.

Martin Shepherd’s Powers Of Attorney Services

There are two main types of powers of attorney:

  1. Ordinary Power of Attorney: This allows someone you trust, like a family member, friend, or solicitor, to manage your financial affairs on your behalf. It is used when you are unable to handle these matters yourself due to a physical disability. You must willingly appoint your attorney, and the arrangement can be cancelled at any time. However, it becomes invalid if you lose mental capacity.
  2. Lasting Power of Attorney (LPA): Unlike an ordinary power of attorney, an LPA remains in effect even if you become unable to manage your affairs due to illness, disability, or accident. There are two types of LPA:
    1. Health and Welfare LPA
    2. Property and Financial Affairs LPA

A Power of Attorney is commonly used to plan for situations where you may become unable to make decisions yourself due to illness, disability, or other reasons. It allows you to choose who will act on your behalf and specifies the extent of their authority.

This person can manage your finances and property, or make decisions about your health and welfare, depending on the type of Power of Attorney you grant.

The two main types of Powers of Attorney are Ordinary Power of Attorney and Lasting Power of Attorney (LPA). An Ordinary Power of Attorney is used when you are temporarily unable to manage your affairs due to physical disability and becomes invalid if you lose mental capacity. On the other hand, an LPA remains in effect even if you lose mental capacity and can cover either Health and Welfare or Property and Financial Affairs.

An Ordinary Power of Attorney is temporary and becomes invalid if you lose mental capacity, while an LPA remains in effect even if you lose mental capacity. LPAs provide more comprehensive and enduring powers to manage your affairs, including both financial and welfare decisions.

You can appoint anyone you trust to act as your attorney, including family members, friends, or solicitors. It’s essential to choose someone who understands your wishes and is willing to act in your best interests.

When setting up a Power of Attorney, you’ll need to provide details about your existing estate planning arrangements, your chosen attorney(s), your assets and income, any special wishes regarding the handling of your property or assets, and, if applicable, permission to speak to your doctor about your health needs.
